Terms of Service

Welcome to kiflat ("kiflat", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, applications, and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using kiflat you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may update these Terms from time to time; continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Age Requirement

You must be at least 18 years old to create an account or use the Service. By using kiflat you represent and warrant that you are 18 or older. Accounts found to belong to minors will be terminated immediately.

3. Accounts & Security

To use the Service you must register an account using a valid email address and password. We strongly recommend enabling two-factor authentication (2FA), which is supported via TOTP. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

4. Authorized Agent for Takedowns

By using the takedown, delisting, or platform-reporting features of the Service, you explicitly appoint kiflat as your authorized legal agent to prepare, sign, and submit on your behalf:

• Notices under the Digital Millennium Copyright Act (17 U.S.C. § 512);
• Google search delisting requests;
• Platform-specific copyright and abuse reports.

This appointment includes the limited authority to use your name, stage name, contact information, and electronic signature for the sole purpose of submitting these notices. You may revoke this authorization at any time by deleting your account.

5. Copyright Ownership & Penalty of Perjury

For every piece of content you ask us to take down or delist, you represent and warrant, under penalty of perjury, that:

• You are the sole copyright owner of the work, or an agent authorized to act on the owner's behalf;
• The use of the material in the manner complained of is not authorized by you, your agent, or the law;
• The information you provide to us is accurate.

Submitting false, misleading, or fraudulent takedown notices through the Service is a violation of these Terms and of 17 U.S.C. § 512(f), and may result in liability for damages and attorneys' fees. We will terminate your account immediately and without refund if we reasonably believe you have submitted false notices.

6. Verification of Aliases and Platforms

To monitor stage names, aliases, and platform accounts on your behalf, we may require you to verify ownership by placing a unique verification code (e.g., kiflat-a3f9) in the bio of the relevant platform account. You agree only to add identities and platform links that you legitimately own or are authorized to manage.

7. Leaker Search & Acceptable Use

The "Leaker Search" feature aggregates data from publicly available third-party data breaches and other public sources, and is provided "AS IS" and "AS AVAILABLE" strictly for informational and defensive purposes, to help you identify and respond to individuals stealing or redistributing your content.

You agree that you will NOT use Leaker Search, or any output from it, to:

• Harass, threaten, intimidate, or stalk any person;
• Dox, publicly expose, or "out" any individual;
• Attempt to access, log into, or impersonate accounts that do not belong to you;
• Engage in any unlawful activity or violation of another person's rights.

Violation of this section will result in immediate, permanent, and unrefunded termination of your account, and may be reported to law enforcement.

8. No Guarantee of Removal

kiflat automates the discovery, preparation, and filing of takedown and delisting requests. However, we do not control third-party hosts, platforms, or search engines, and we do not guarantee that any specific notice will result in removal, delisting, or any particular response. Compliance with notices is at the sole discretion of the receiving party.

9. Subscriptions, Billing & Refunds

Paid plans are billed through Stripe, our payment processor. By subscribing you authorize Stripe to charge your payment method on a recurring basis (monthly or annually, depending on the plan you select). Subscriptions renew automatically until cancelled.

You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Deleting your account immediately cancels your subscription. Except where required by law, fees already paid are non-refundable, and we do not provide refunds for partial billing periods or unused time.

10. Acceptable Use

You agree not to (a) reverse-engineer, scrape, or interfere with the Service; (b) use the Service to violate any law or third-party right; (c) submit content you do not own or have rights to; or (d) attempt to gain unauthorized access to any part of the Service or its underlying infrastructure.

11. Termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, abused the Service, or created risk or possible legal exposure for kiflat or other users. You may terminate your account at any time by using the "Delete Account" feature in your Security settings.

12. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. kiflat IS NOT A LAW FIRM AND DOES NOT PROVIDE LEGAL ADVICE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL kiflat, ITS OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID kiflat IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless kiflat and its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content or notices you submit through the Service.

15. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which kiflat is established, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the competent courts of that jurisdiction, except where applicable law grants you a non-waivable right to bring proceedings elsewhere.

16. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use after the effective date of the revised Terms constitutes acceptance.
